D’Ambrosio Brown Obtains Dismissal of Federal Civil Rights Lawsuit

D’Ambrosio Brown Attorneys obtained dismissal of a federal civil rights lawsuit against the Town of Norfolk’s municipal inspectors.  The Plaintiff, a land developer in the Town of Norfolk, filed a 10-page, multi-count lawsuit alleging that the town inspectors engaged in retaliatory code enforcement in response to his complaints about their conduct and decisions on development projects.  In addition to alleging federal civil rights violations, Plaintiff also alleged that the inpsectors’ conduct violated the Massachusetts Civil Rights Act and constituted interference with Plaintiff’s contractual relations and civil conspiracy.

In moving to dismiss the entire lawsuit on the grounds that the alleged retaliatory code enforcement was both factually and legally deficient, the Court agreed with D’Ambrosio Brown’s argument and dismissed the Complaint.
