D’Ambrosio Brown Obtains Favorable Ruling Allowing Client to Be Removed as a Defendant in a Multi-Party Products Liability Case
D’Ambrosio Brown attorneys obtained a favorable ruling on a motion for judgment on the pleadings that allowed its client to be dismissed as a defendant in a heavily litigated products liability case. The client, a safety consultant, was one of five named defendants in a products liability case involving a serious industrial accident. After the client settled her claims with the plaintiff, one of the co-defendants continued its litigation of a tort-based derivative liability cross-claim against her, thus keeping her in the lawsuit following her settlement. D’Ambrosio Brown filed a motion for judgment on the pleadings, arguing that the indemnification cross-claim had no basis in fact or law. A Middlesex Superior Court Judge agreed, and ruled in the client’s favor on the motion, ending her involvement in the lawsuit. See Kinghorn v.
